When Subject returned to work, she had reasonable cause to suspect that Service Recipient’s injury was a significant incident. Had duty to report.

Category 2 neglect found. Subject failed to properly supervise as per facility policy. Category 3 abuse, obstruction unsubstantiated. No evidence that investigation was impeded.

Category 2 neglect and Category 2 abuse (obstruction of reports of reportable incidents) both substantiated, reduced to Category 3, failed to show serious endangerment.

Category 3 obstruction found. Subject failed to report inappropriate mealtime restraint of Service Recipient to VPCR after learning of incident from parents.

Category 2 abuse (obstruction of reports of reportable incidents) not found. Subject’s entry of false information in logbook not found to have impeded investigation.

Category 3 obstruction found. Subject failed to make VCPR report after witnessing other staff’s unauthorized conduct toward a Service Recipient.

Category 3 obstruction of reports unsubstantiated where the evidence did not support allegation that Subject intentionally falsified records or that his statement impeded the investigation.

Category 3 abuse and neglect not found. Subject testified credibly that Service Recipient was having a behavior and not being harmed. No breach of duty.

Category 3 abuse found. Subject failed to report a reportable incident. Subject’s assertion that she was not trained to properly report was not credible.  

Category 3 abuse and neglect found. Subject breached a duty by falling sleep and falsely documented completing required bed checks. Harm was likely.
