Category 2 neglect found. Subject failed to provide required 2:1 supervision of Service Recipient during outing with other Service Recipient & staff.

Category 2 neglect: Service Recipients unprotected from unsafe water. No fire drills. Category 3 neglect: proper supervision not given. Category 2 neglect not found regarding personal care plan failure.

2 allegations affirmed for excessive force and improper technique with no emergency exception. 1 physical abuse reversed: no proof that scratches occurred during restraint.

Category 2 physical abuse, deliberate inappropriate use of restraints and Category 3 neglect found. Subject shoved and held Service Recipient down on neck; failed to use de-escalation techniques. 

Category 3 negelct substantiated. Subject left naked Service Recipient unstrapped in wheelchair. Category 2 neglect substantiated. Subject exited facility with service recipient naked in bath. 

Video shows Subject restraint deliberately inconsistent with PMCS, failure to deescalate a breach. Subject physical contact was reckless.

Category 2 physical abuse/restraint, Category 3 neglect found. Subject in OCFS facility found to have used unwarranted restraint with unauthorized technique and unreasonable force.

Category 2 neglect unsubstantiated. No evidence Subject 1’s delay in reaching nurse on Service Recipient’s seizure caused impairment. Category 3 neglect unsubstantiated for Subject 2: no duty found.
